Welcome to Daily Motivational, operated by WARESOUL LLC ("we," "us," or "our"). By downloading, accessing, or using our mobile application ("Daily Motivational" or the "App"), you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use the App.

Daily Motivational is a motivational quotes application that provides:

• Curated collection of inspirational and motivational quotes
• Personalized quote recommendations
• Quote collections and favorites management
• Daily quote notifications (optional)
• Social sharing features
• Beautiful customizable themes and backgrounds

3. User Accounts and Data

Daily Motivational operates primarily as a local-first application. Your favorites, collections, and preferences are stored locally on your device. We do not require account creation for basic functionality.

4. Acceptable Use

When using Daily Motivational, you agree to:

• Use the App for personal, non-commercial purposes
• Respect intellectual property rights of quote authors and creators
• Not attempt to reverse engineer or modify the App
• Not use the App for any illegal or unauthorized purpose

5. Intellectual Property

The App and its original content, features, and functionality are owned by WARESOUL LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Quotes themselves are attributed to their respective authors and are used for educational and inspirational purposes.

6. In-App Purchases and Subscriptions

Some features may require in-app purchases or subscriptions. All purchases are processed through Apple's App Store and are subject to Apple's Terms of Sale. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscriptions through your App Store account settings.

7. Advertisements

The App may display advertisements. We use third-party advertising partners to serve ads. With your permission (via App Tracking Transparency), we may share information with advertising partners to provide more relevant advertisements. You can opt out of personalized advertising through your device settings.

8. Quote Attribution and Copyright

Quotes displayed in the App are attributed to their original authors and sources. We respect intellectual property rights and use quotes for:

• Educational and inspirational purposes
• Non-commercial personal use by our users
• Fair use under applicable copyright laws

9. Sharing and Screenshots

The App allows you to share quotes via social media, messaging, and other platforms. When you share:

• You're responsible for complying with each platform's terms of service
• Quote attribution is included in shared content
• We do not control how third-party platforms use shared content
• Shared content may be subject to those platforms' privacy policies

10. Subscription Terms

Premium subscriptions are managed through Apple's App Store. By subscribing:

• Subscriptions auto-renew unless canceled 24 hours before period end
• Payment is charged to your iTunes Account at purchase confirmation
• Manage subscriptions in App Store Account Settings
• Cancel anytime; no refunds for partial periods
• Free trial (if offered) converts to paid subscription if not canceled
• Pricing may vary by region

11. User Content and Feedback

If you provide feedback, suggestions, or report issues through the App, you grant us a non-exclusive, worldwide, royalty-free license to use that feedback to improve our services.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free from viruses or harmful components
• Results from using the App will meet your requirements

13. Limitation of Liability

To the maximum extent permitted by law, WARESOUL LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

• Your use or inability to use the App
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the App
• Any other matter related to the App

14. Indemnification

You agree to indemnify and hold harmless WARESOUL LLC from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App or violation of these Terms.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications. Your continued use of the App after changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may terminate your use by deleting the App from your device.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Delaware.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and WARESOUL LLC regarding the App and supersede all prior agreements and understandings, whether written or oral.
